Elitedrive Affiliates Terms of Service

4. Affiliate Payment Terms

• Payments are made via PayPal.
• Payments made are to the Paypal email address provided. Incorrect details may result in loss of payment to the affiliate
• Payments are made on the 20th of every month.
• The minimum threshold for requesting a withdrawal is $100 NZD.
• Payments are processed 31 days from the date of the referral order to account for returns and cancellations.
• Commission payments will only be honored at the current affiliate percentage rank rate at the time of each order referral and only if the affiliate’s unique referral link has been used to obtain the order referral.
  
  

5. Promotion and Advertising

Affiliates are free to promote their websites, but any promotion that mentions Elitedrive could be perceived by the public or the press as a joint effort. Affiliates should know that certain forms of advertising are always prohibited by Elitedrive. For example, advertising commonly referred to as “spamming” is unacceptable to us and could cause damage to our name. Other generally prohibited forms of advertising include the use of unsolicited commercial email (UCE) and posting to non-commercial newsgroups and cross-posting to multiple newsgroups at once. Affiliates must use only the digital creative images supplied within the affiliate program for promotion.

6. Intellectual Property Rights

Elitedrive grants you a non-exclusive, non-transferable, revocable right to (i) access our site through HTML links solely in accordance with the terms of this Agreement and (ii) solely in connection with such links, to use our logos, trade names, trademarks, and similar identifying material that we provide to you or authorize for such purpose. You are only entitled to use the Licensed Materials to the extent that you are a member in good standing of the Affiliate Program.

7. Termination

Either you or we may end this Agreement AT ANY TIME, with or without cause, by giving the other party written notice. Written notice can be in the form of mail, email, or fax. Additionally, this Agreement will terminate immediately upon any breach of this Agreement by you.

8. Limitation of Liability

We will not be liable for indirect or accidental damages (loss of revenue, commissions) due to tracking failures, loss of database files, or any results of “intent of harm” to the program and/or our website. We make no claim that the operation of the Program and our website will be error-free and we will not be liable for any interruptions or errors.

9. Tax / GST

Payments made to affiliates do not cover any taxes and/or GST. It is the full responsibility of the affiliate to organize their own individual tax and/or GST obligations from affiliate commission(s) and all earning(s) paid from Elitedrive.

10. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of New Zealand, without regard to the conflict of laws and principles thereof.

11. Modification

We may modify any of the terms and conditions within this Agreement at any time and at our sole discretion. These modifications may include, but are not limited to, changes in the payment procedures and Elitedrive Affiliate Program rules. If any modification is unacceptable to you, your only option is to end this Agreement. Your continued participation in the Elitedrive Affiliate Program following the posting of the change notice or new Agreement on our site will indicate your agreement to the changes.

12. Miscellaneous

This Agreement constitutes the entire agreement between you and Elitedrive with respect to the Affiliate Program.
